This year, the Windstorm Insurance Network (WIND) will be holding its 14th Annual Windstorm Insurance Conference at the Renaissance Sea World in Orlando, Florida. For three days, from January 28 to the 31st, this important industry conference will draw representatives from all segments of the windstorm insurance claims and wind / water damage restoration industry to share insights into current trends and recent developments, many of which pertain specifically to our Florida concerns and the building trades.

The Annual Conference consists of presentations and workshops for professional development plus continuing education credits for numerous states, bar associations and professional designations, in addition to outstanding professional networking. WIND anticipates more than 1,500 insurance and restoration professionals will be attending, including government agency representatives and other professionals concerned with windstorm claims, property insurance and property restoration issues. There’s a lot going on!

This year’s presentations will delve into impacts from recent super-storms and hurricanes, the special legal issues they raised, construction-related concerns, and other windstorm and water damage, insurance and legal issues. This short sample of conference sessions exemplifies the content of special interest to contractors and our industry-professional relationships:

    Hurricane-related Claims and Coverage issues from hurricanes Katrina, Charley, Irene and Sandy, including legal issues regarding wind vs. water; state regulatory requirements; executive orders and bulletins affecting deductibles and holdbacks; and the parties’ mutual good faith cooperation in the submission, handling, adjustment and investigation of “super storms” claims.

  • Hypothetical Wind vs. Water Claim – Building damage issues.
  • Building Envelope Failure during a Wind Event – Damage to buildings, their individual components and structural systems, and the relationship of the building envelope with respect to the integrity of the structure during a high wind event.
  • “Aging” of Water Damage – Recent research and technical information evaluating the impact of water exposure on various building materials.
  • Gulf Coast / Southeast insurance case law update, and other legal sessions on windstorm and property claims law issues – such as Assignment of Benefits in the property loss arena, Bad Faith causes of action and bad faith damages from Texas to Florida, preparation of insurance adjusters for depositions and more.

Among the Florida-specific issues to be covered in some depth at the conference, issues directly impacting general contractors and sinkhole repair specialists like Foundation Services, are the following breakout sessions:

  • Impact of the 2010 Florida Building Code on Wind and Flood Losses – The changes, realized impacts, anticipated litigation, anticipated Ordinance and Law coverage issues and the current state of enforcement, also including the challenges and lessons learned regarding restoration of wind and flood damaged structures. These are all-too-familiar issues for our customers and our Florida Source Construction’s property restoration and new construction services in the wake of recent years’ super-storm ravages of Florida communities.
  • Sinkholes: The Evolution of Florida Claims During 2012 – Although sinkholes have been developing in Florida since it raised out of the sea, sinkhole claims handling has cutting edge elements due to recent, sweeping Legislative changes and Court interpretations. This breakout session promises to provide a practical approach to navigating sinkhole claims adjustment, as well as the latest Court holdings regarding allowing neutral evaluation reports to be introduced into evidence, Trial Court opinions, jury verdicts and Appellate decisions. These matters affect the entire sinkhole repair industry in Florida and are of major interest to our foundation repair, sinkhole remediation and soil stabilization specialty services…and our customers!
  • Florida Property Insurance Law Update re: Wind and Related Cases – The impact of case decisions plus practical considerations for claims handling based on any changes or clarifications of existing law.
